Signatures on non-recordable documents, e.g. powers of attorney, affidavits, consents, copies of IDs, diplomas, transcripts, etc. can be notarized by a New York notary public. Here are a few general guidelines:
The document must be signed and properly notarized by a notary public. The notary must use a notarial certificate, otherwise the document cannot be apostilled (See sample notarial statements below)
If the document is signed by more than one person, the notary should indicate whose signature(s) he/she is notarizing.
Recordable documents that are issued by a state agency/officer (e.g. birth, death, marriage certificates, divorce jusgments, articles of incorporation, etc.) cannot be notarised.

Apostille requirements for electronically / remotely notarized documents
For electronic notarial acts performed remotely, the following statement must be added to the acknowledgment or jurat:
“This electronic notarial act involved a remote online appearance involving the use of communication technology.”
For apostille purposes, the remote notarization must be accompanied by the Certificate of Authenticity. A Certificate of Authenticity is a paper document that a notary public creates to attest that an electronically notarized document is an accurate copy. A Certificate of Authenticity is required to record a tangible copy of an electronically notarized document with a county clerk.
- The certificate must be ink-signed by the notary
- It must include the notary's title, official stamp or registration number, and the expiration date of their commission
The notary must be in NYS but the person using the services can be any place provided that if the person is not in the US, the following additional rule applies:
If the principal is located outside of the United States, the notary must verify, through verbal confirmation made by the signer in the course of the recorded electronic notarial act, that the record or subject of the notarial act:
(1) is to be filed with or relates to a matter before a public official or court, governmental entity, or other entity subject to the jurisdiction of the United States; or
(2) involves property located in the territorial jurisdiction of the United States or involves a transaction substantially connected with the United States;
