Birth certificates

Divorce records
In the State of New Jersey divorce judgments are issued by the court in the county where the divorce was registered.
If the divorce judgment is signed by a Judge of the Superior Court, most likely it will be eligible for an apostille.
Certified copies of the divorce judgments can also be signed by the Clerk of the Superior Court or Deputy Clerk of the Superior Court. These documents are also eligible.

Single status documents
Anyone who is planning to get married in a foreign country will be asked to provide this document as proof that he or she is free to marry.
In the State of New Jersey you have two options:
Option 1:
The State of New Jersey can issue a "No Record of Marriage" Statement.
Option 2:
(B) Or, you can prepare a Single Status Affidavit that will be signed by you and notarized by a New Jersey notary public. An Affidavit of Single Status is a sworn statement in which you attest that you are single and free to marry.

For apostille / legalization purposes, your Single Status Affidavit must be original. Photocopies, digital copies, notarized copies are not acceptable.

Powers of attorney, affidavits, consents
Powers of attorney, affidavits, consents must be original (have the original signture(s) of the signer(s). Photocopies, digital copies, notarized copies are not acceptable.
These documents should be properly notarized. Electronically (remotely) notarized documents are not eligible for apostilles. The signatures of the signer(s) and the notary must be original.
If you need to get a New Jersey apostille for a power of attorney, authorization, consent, affidvavit notarized by a New Jersey notary public - make sure the notary includes a certificate of acknowledgment or jurat. If there is no notarial statement on the document (just the signature and the stamp), the document will be rejected!
If there are more than one signer on the document, the notary should indicate whose signature(s) he/she is notarizing.
The State of New Jersey does not apostille documents where the notary's license has expired. Active notaries only.

School diplomas and transcripts
Academic documents such as diplomas, transcripts, verification letters and general school records issued by high schools, colleges, and universities of New Jersey, must be certified by the school registrar, and notarized prior to be presented for an apostille.
A certified copy must have the original signature of the school official and his/her signature must be notarized by a New Jersey notary public.
The notary must use a certificate of acknowledgment or jurat. Just a signature and a stamp are not sufficient. If the document is not properly notarized, it will be rejected.

Passports, IDs
How to prepare a copy of your passport, your New Jersey driver license or ID for foreign use?
Option 1:

In the State of New Jersey the notaries are allowed by law to attest to copies of the documents.

Driving records
In the State of New Jersey, driving records (called "Abstract of Driver History Record") are issued by Motor Vehicle Commission and are signed by Chief Administrator (Acting Chief Administrator). These documents must be certified. If certified, these documents can be apostilled both as originals and as PDF files downloaded form Motor Vehicle commission website.
Criminal records
In the State of New Jersey, the background checks are done by The Division of State Police, Criminal Information Unit (CIU). The search is finger-print based.

FBI background checks
The State of New Jersey does not issue apostilles for FBI background checks. FBI background check (also called Identity History Summary) is a federal document, therefore it has to be apostilled on the federal level. Federal apostilles are issued by the U.S. Department of State in Washington DC.
Please note that this document does not need to be notarized.

How to get your criminal background check from the FBI?
The FBI offers two methods for requesting you criminal background check (Identity History Summary Check)
Option 1: Submit your request directly to the FBI
Option 2: Submit to an FBI-approved Channeler. Note that FBI-approved Channelers may only process requests for a U.S. person (an individual who is a U.S. citizen or a lawful permanent resident)

Form 6166 (U.S. Residency certification) is a letter printed on the U.S. Department of Treasury stationery certifying that an individual was/is a resident of the United States for the purposes of income tax laws of the United States. You may use this form to claim income tax treaty benefits and certain other tax benefits in foreign countries.
The State of New Jersey. does not issue apostilles for Form 6166. It is a federal document, therefore it requires a federal apostille. Federal apostilles are issued by the U.S. Department of State in Washington DC.

Articles of incorporation, organization, certificate of incorporation
New Jersey Certificate of Incorporation (or Articles of Organization, in case your company is a New Jersey LLC) is the document that you filed with the New Jersey Secretary of State when your company was incorporated / organized. This document confirms that your company was registered as a legal entity, it does not show your present active status (for this purpose you will need a Certificate of Good Standing (the State of New Jersey calls it a "Certificate of Standing")
For apostille or legalization purposes, you will need a certified copy issued by the New Jersey Secretary of State. Notarized copies are not acceptable for apostille purposes.

Certificates to Foreign Government, documents issued by U.S. federal agencies
If your company is exporting products to a foreign country, the destination country government will request a Certificate to Foreign Government which will guarantee that the product is in compliance with U.S. laws and U.S. regulations.
The State of New Jersey does not issue apostilles for federal documents. A Certificate To Foreign Government is issued by a federal afency (FDA). These documents requre federal apostilles issued by the U.S. Department of State in Washington DC.

Can a New Jersey notary attest copies of corporate documents?
Yes, except for for documents that are issued by a public records office (e.g. the New Jersey State Treasurer, Chief Examiner, New Jersey Secretary of State, etc.). A copy certification is performed by a notary public to confirm that a reproduction of an original document is true, exact and complete. Such originals might include copies of resolutions, by-laws, operating agreements, board of directors decisions, etc., which cannot be copy-certified by a public record office.

What does a "proper notarization" mean in the State of New Jersey?
Signatures on non-recordable documents, e.g. powers of attorney, affidavits, consents, copies of IDs, diplomas, transcripts, etc. can be notarized by a New Jersey notary public. Here are a few general guidelines:
The document must be signed. The signature(s) of the signer(s) must be original.
The document must be notarized by an active notary public. If the notary's license has expired, the document will not be accepted for an apostille. You can check if the notary public is active here...
If the document is signed by more than one person, the notary should indicate whose signature(s) he/she is notarizing.
The document must be notarized properly. The notary must use a notarial certificate, otherwise the document cannot be apostilled. See sample notarial statements below..

Can a New Jersey notary certify a copy of a document?
Yes, the State of New Jersey allows copy certification by notaries public. However, the following documents cannot be copy-certified:
- vital records (birth, marriage, death certificates)
- court issued documents (divorce records)
- certificates of incorporation and certificates of good standing issued by the Office of the State Treasurer
Copies of diplomas and transcripts can be copy certified. Please check with the receiving foreign school / agency if they will accept a notarized copy. Many foreign schools require an original transcript signed by the school principal or registrar.

Can New Jersey notaries attest to copies of the documents?
Yes, except for vital records (birth, marriage, death certificates), documents issued by the courts (divorce judgments) or any other public records office. A notarial officer may not certify or attest a copy of a public record of this state. A copy certification cannot be performed on copies of a document or a certified copy. Can a remotely or electronically notarized document be apostilled in New Jersey?
No. For notarized documents, the State of New Jersey requires the original signatures of both the signer and the notary.
Does the State of New Jersey issue electronic apostilles?
No. The State of New Jersey issues paper apostilles only.

For documents in languages other than English, the State recommends that you attach a notarized English translation.
