A New York State Apostille is a one page document embossed with the Seal of the New York State Department of State. The apostille includes the facsimile or original signature of the state official.

  • Hague Countries accept Apostilles

Hague coutries are the countries that have joined the 1961 Hague Convention. Documetns legalized by an Apostille are accepted in all Hague countries.

  • Non-Hague countries requre Embassy authentication

Non-Hague coutries are the countries that have not joined the Hague Convention. Non-Hague countries do not accept documetns legalized by an Apostille. Embassy authentication / legalization is required

IMPORTANT NOTICE RELATING TO APOSTILLES

The New York State Department of State has revised the method in which it issues apostilles.

1. Revised Seal - The New York State Department of State Seal will be used for the apostille and authentications. The Great Seal of the State of New York will no longer be used.
2. Revised Method for Affixing Seal - Apostilles and authentications will be produced with a blue laser printed facsimile of the New York State Department of State Seal.

Legalization Requirements: Is Your Marriage Certificate Acceptable for Legalization?

  • If the marriage was registered in New York City (Bronx, Kings, Manhattan, Queens, Staten Island) the marriage certificate must have a color stamp and the original signature of the City Clerk on the back.

  • If the marriage was registed outside New York City, the marriage certificate must be issued either
  • by NYS Department of Health and bear the signature of Director of Vital Records, or
  • by a Local Registrar

  • Why do I need an Apostille or Embassy Seal for my Marriage Certificate?

If the document is intended for use in a foreign country it has to be legalized (another word is “authenticated”) for foreign use. This is a process in which various seals are placed on the document. Apostille (for Hague countries) and Embassy Seal (for Non-Hague countries) make the document valid in a foreign country.

  • How do I obtain an Apostille for my New York Marriage Certificate?

  • Why are some Marriage Certificates issued by New York City Marriage Bureau, and some - by New York State Department of Health?
If your marriage was registered within five boroughs of New York City (Bronx, Kings, Manhattan, Staten Island, Queens), the information of your marriage registration is filed with the New York City Marriage Bureau. If your marriage was registered in any other county, the marriage certificate should be obtained from the NYS Department of Health or from the local Registrar.

For NYC Marriage Certificates, it takes 48 hours, for marriages registered outside New York City - 7-8 business days.
